On the 29th, a reporter from the Beijing News learned from the People’s Court of Xicheng District, Beijing, that the court sentenced the man to 11 years in prison for theft, deprived of political rights for 2 years, and fined him 110,000 yuan.

  Tang Mou, male, 40 years old, master's degree, Beijing nationality, was tried on June 30 at the People's Court of Xicheng District, Beijing on suspicion of theft.

  According to the court, at 7 o'clock on June 10, 2019, Zhao found that the white Porsche small off-road vehicle parked in the parking lot of a hotel in Xicheng District was missing. After checking the hotel surveillance, he found that the car was towed away at about 1 am , Tang was at the scene when towing.

When Zhao asked Tang for the vehicle, Tang lied that the vehicle was seized by the court and refused to return it.

The towed vehicle was purchased by Zhao using Tang's car purchase quota.

  The public prosecution agency believed that Tang had secretly stolen other people’s property for the purpose of illegal possession and violated the property rights of citizens. The amount was extremely large, and he should be investigated for criminal responsibility for theft.

  The car sales contract shows that on July 30, 2018, Zhao bought a Porsche cash Macan for 602,700 yuan, with a deposit of 120,000 yuan.

A supplementary agreement was signed on the same day, which stated that “the customer may change the purchaser when issuing the ticket due to index issues when the customer is on the Beijing license plate. After the license is issued, the seller must provide the driving photo to the seller”.

  According to the Beijing Minibus Index Lease Agreement, Tang will lease his own Beijing Minibus Index to Zhao for the lease term from December 30, 2018 to December 31, 2028.

  In order to prove that the car was purchased by Zhao, on December 27, 2018, Tang signed a loan contract with Zhao. The content was that Zhao borrowed 602,700 yuan from Tang, and Tang used Zhao to purchase the vehicle with Tang’s car purchase index. Mortgage to Zhao, and hand over the vehicle keys, motor vehicle registration certificate, driving permit, vehicle purchase invoice, purchase tax, road maintenance fee, insurance documents, household registration book and copy of ID card to Zhao for safekeeping.

  During the trial, Tang’s defender mentioned that there was an economic dispute between Tang and Zhao. Tang lent Zhao to 700,000 yuan, but Zhao did not repay the money.

However, according to Zhao's statement, witness testimony and bank account details, there is no economic dispute between Tang and Zhao or Deng.

  In addition, Tang lent his car quota to Zhao to buy a car, and Zhao actually paid for the purchase, and the purchased vehicle was actually owned by Zhao and was Zhao’s legal property.

Tang tow Zhao's vehicle away without Zhao's knowledge. When Zhao asked for the vehicle, Tang refused to return it. He obviously had the subjective intention to illegally occupy Zhao's vehicle.

Tang had stolen citizens’ property, the amount of which was extremely large, infringing on the ownership of citizens’ property, and his act constituted the crime of theft.

  The Xicheng Court sentenced Tang to 11 years in prison, deprived of political rights for 2 years, and fined him 110,000 yuan.

During the appeal period, Tang did not appeal.
