Wearing a mask is no longer compulsory in Saint-Brieuc (Côtes-d'Armor).

The administrative court of Rennes suspended Wednesday the order of the mayor of the city dated July 20 which imposed the wearing of masks for all people aged eleven and over.

To justify its decision, the court considers that “the obligation to wear a mask in public traffic areas may be liable (...) to constitute an attack on the freedom to come and go and the right of everyone to respect for his personal freedom ”.

A "disproportionate" order according to a resident

In addition, “it does not appear from the documents produced by the municipality of Saint-Brieuc (…) that the epidemiological situation (…) constituted, on the date of issue of the decree in dispute, a particular local situation likely to characterize a compelling reason making it essential to issue more restrictive measures than those taken simultaneously by the Prefect of Côtes d'Armor ”.

The administrative court had been seized in summary proceedings by a resident of Saint-Brieuc considering that the decree was "disproportionate", in particular because it enacted these measures "until further notice" and that it infringed "the freedom to come and go ”.
