The Changde City Intermediate People's Court found after trial: Defendant Yang Baiqi began to have negative emotions and pessimism in the first half of 2018, and gradually developed into suicidal thoughts.
On March 23, 2019, Yang Baiqi left the school dormitory alone with a dagger and other crime tools, and stayed in an Internet cafe and other places in Dingcheng District, Changde, until about 22 o'clock that night. Then he thought of killing one person and then committing suicide.
Yang Baiqi used the Didi taxi-hailing software to make random appointments to the Xiang J car driven by the victim Chen.
At about 23:40, when the car drove to the entrance of a square, Yang Baiqi suddenly took out a dagger and stabbed the victim Chen until he lost the ability to resist and fled the scene.
Later, Yang Baiqi surrendered to the public security organs under the persuasion of his ex-girlfriend.
After being identified in accordance with the law, the victim Chen died of heart failure by piercing the heart with a single-edged sharp instrument.
Appraised by the Judicial Appraisal Center of the Second Xiangya Hospital of Central South University, Yang Baiqi was diagnosed with depression and limited (partial) criminal liability when committing harmful acts.
The Changde City Intermediate People's Court held that the defendant Yang Baiqi deliberately and illegally deprived others of his life with a dagger, causing one person to die. His actions constituted the crime of intentional homicide, and the prosecution agency charged the crime.
Yang Baiqi's intentional murder has despicable motives, cruel methods, and serious consequences, which should be severely punished.
After the incident, Yang Baiqi voluntarily surrendered to the public security organs, and his close relatives compensated for the funeral expenses. It was verified that Yang Baiqi had the ability to limit (partially) criminal responsibility when committing harmful acts.
Therefore, the above judgment was made in accordance with the law.
