Actor Kwak Hyeon-hwa from comedian won a lawsuit for compensation for damages filed against the film director, claiming that he suffered mental pain by distributing a film containing the exposed upper body without his consent.



On the 23rd, Judge Lee Ye-rim, who was solely responsible for the civil affairs of the Seoul Central District Court, ruled over some of the plaintiffs, saying, "Pay 20 million won to Mr. Kwak" in a lawsuit filed by Kwak Hyun-hwa against director Lee Soo-seong.



However, Kwak Hyeon-hwa's claim that the online math lecture contract was terminated due to the exposure scene, resulting in property damage, was not accepted.



In April 2012, Kwak Hyun-hwa signed a contract to appear in a movie with director Lee Soo-seong.

At the time of signing the contract, Kwak Hyeon-hwa expressed his intention not to shoot the exposed upper body orally.



However, when the filming began, director Lee Soo-sung persuaded that it was "a necessary scene in the flow of the film", and Kwak Hyun-hwa responded to the filming under conditions that he later decided whether to disclose the exposure scene.



As requested by Kwak Hyun-hwa, director Lee Soo-sung deleted the exposed scenes at the opening of the theater in 2012, but added the scenes in November 2013 and provided them to Internet TV (IPTV) and file sharing sites for a fee.




Accordingly, Kwak Hyeon-hwa filed a lawsuit claiming 30 million won for property damage and 70 million won for alimony due to mental suffering, claiming that his personal rights were violated by revealing the exposure without permission.



The court judged that "(director Lee) committed an illegal act that violated the plaintiff's right to portrait by promulgating an unremoved version of a movie containing a breast-exposed scene that caused sexual shame without Kwak's consent."



In relation to this case, director Lee Soo-seong was also charged with shooting using cameras and innocence under the Sexual Violence Penalty Act in June 2016, but was convicted in the Supreme Court in 2018.
