The town seized the administrative court of Nice as part of a procedure of "summary freedom" to try to suspend the decision of the prefect of the Alpes-Maritimes.
The debate before the court is scheduled for Wednesday at 2:30 p.m. and the decision expected in the afternoon.
Decrees requiring the wearing of masks have already been canceled by the courts.
This was still the case on Monday: the Strasbourg administrative court ordered the prefect of Bas-Rhin to rewrite her decree on the compulsory wearing of a mask in Strasbourg.
In Nice, the administrative court had on the contrary validated, in August, the appeal for excess of power brought against the municipal decree of Christian Estrosi.
