The Keeper of the Seals Nicole Belloubet asked her services on Wednesday to prepare a new draft decree on protection orders for victims of domestic violence, in the face of harsh criticism of the previous text.

The decree of May 27 was to put into practice the Pradié law proposal adopted in December, which fixes a six-day period for the family judge to rule on a request for a protection order, a device intended to shelter victims.

But another delay, introduced in this decree, caused the indignation of feminist associations: it provides that the victim informs, by bailiff and at his expense, his violent spouse or ex-spouse, of the procedure opened against him in a twenty-four hour period, on pain of cancellation of the procedure. For associations and deputy Aurélien Pradié (LR) this new rule risks producing the opposite effect to that expected, which is why they asked the minister to "withdraw this decree".

Faced with these criticisms, the Minister of Justice had mentioned Tuesday in Parliament possible arrangements.

The senior official for equality between women and men, Isabelle Rome, held a meeting on Wednesday with the actors concerned by the new procedure for issuing protection orders, associations for the protection of women's rights, bailiffs, lawyers and magistrates.

"These discussions made it possible to show that the 24-hour period could be doubled to be extended to 48 hours while allowing the parties to be assisted by a lawyer, that the failure to observe this period should not be raised automatically by the judge and that an effective service circuit was necessary to meet the deadline set by the legislator, "said the Minister of Justice in a press release published after the meeting.

"It also appears necessary that this device can be financed by legal aid," added the ministry.

The new draft decree "will be submitted to the national steering committee for protection orders which will meet on June 23," announced the Chancellery.
