In order for insurance companies to compensate professionals who suffered operating losses during the coronavirus crisis, a lawyer is launching collective proceedings. - GILE MICHEL / SIPA

Martial Léotard has decided to chain himself every day in front of the headquarters of the Mutuelle de Poitiers in Ligugé (Vienne) to claim compensation for loss of business that his insurer challenges him. This manager of Richelieu (Indre-et-Loire) asked the insurer for 62,000 euros in the context of the operating loss of his company, linked to the epidemic of Covid-19.

"I am covered under an administrative closure for contagious disease and therefore for an epidemic ... but not for a pandemic!" This is what our insurance agent in Loudun tells us, because this word pandemic has been removed from contracts for a few years, while we are paying for all risks, fire, water damage ... We are told that if it had been a simple epidemic, we would be covered but not there. It is inaudible for the entrepreneur that I am, ”protests the entrepreneur at the head of the SARL Les Ducs de Richelieu (receptions and weddings).

A “derisory” compensation amounting to 1.7% of turnover

According to Martial Léotard, the Mutuelle de Poitiers only offered compensation up to 1.7% of turnover, an amount he qualified as "derisory". Despite an attempt at dialogue, the discussion was cut short, each one sticking to his position. "We apply our insurance contracts," said the general manager of the Mutual of Poitiers, Stéphane Désert. The operating loss guarantee cannot work. The pandemic risk is not guaranteed. It is a systemic risk that affects everyone, which we cannot insure financially. "

Martial Léotard was chained to his lamppost again, this Wednesday, for the second consecutive day, after a night of rest. Anyone who wants to “go all the way” plans to come back every day of the week, from 9 am to 5 pm, until they succeed.
