However, none of these pilots are salaried in France and pay their social contributions there, even though about twenty of them operate mainly from the national territory  ”. And France is "  by far, the country most served by (this) company for fifteen years  ".

Jean-Baptiste Djebbari told Mediapartthat he was only responsible for the" security "of the flights and of the flight operations control center, but not for the definition of the schedules. He indicates that he was "not in charge of the social, fiscal and human resources management" of Jetfly and that he had "no regulatory or operational responsibility" on these subjects, which were "the sole responsibility of the general management  ”.

However, the Secretary of State is also a "  judicial expert in matters of concealed work  ". This is what Mediapart recalls , by pointing out a European legal provision according to which “  any employee domiciled in a Member State (must be) affiliated to the social security of that State, as soon as he exercises a“ substantial part of his activity there. […] Without necessarily being the major part  ”.

For its part, a source in the entourage of the Secretary of State quoted by Agence France Presse states that " the company has made its position precisely stated  in the article, Mediapart makes a different interpretation of it (and that) The Minister was neither manager, nor shareholder, nor in charge of the social or fiscal policy of the company, he was in charge of the pilots on the operational plan  ”, according to this source quoted by AFP.
