Motorists who commit a traffic violation with their phone in hand will now have their driving license immediately retained - RAPHAEL BLOCH / SIPA

Driving phone + Offense = bye bye permit. From this Friday, if you commit a traffic offense and you were in possession of your mobile phone in hand, your driving license will be automatically retained. All offenses are affected by this measure, whether it be a blinker fault, crossing a solid line, speeding, refusal to give priority to pedestrians or dangerous overtaking.

Beyond the 72 hours of detention, the prefect may order a license suspension of up to six months and even a year in the event of an accident, driving under the influence of alcohol or after using a narcotic. A drastic sanction, but necessary for Road Safety according to which the telephone while driving is responsible for one bodily accident in 10 and multiplies the risk of accident by three.

Fine of 135 euros for night establishments without breathalysers

Other measures, which had been taken during an interministerial road safety council in January 2018, also come into force this Friday after publication the day before the implementing decree in the Official Journal. Thus, the maximum duration of obligation to drive only a vehicle equipped with a breathalyser (EAD), which requires to breathe in a breathalyzer and blocks the vehicle if the blood alcohol level is too high, goes from six months at one year. This measure is pronounced as an alternative to the suspension of driving licenses.

The obligation to provide breathalyzers in night establishments is strengthened and now exposes offenders to a fine of 135 euros. However, it is no longer compulsory to have a breathalyzer in your vehicle.
