Pacific said that in 2018, after being owed by Gaoyi County in Hebei Province for nearly 10 million yuan, they brought the Gaoyi County Government and Gaoyi County Housing and Construction Bureau to court.
According to the relevant judgment of the Intermediate People ’s Court of Shijiazhuang City, Hebei Province, in 2013, the Pacific Company and the Gaoyi County Government signed a cooperation framework agreement on the construction of some infrastructure projects.
Subsequently, Pacific Company and Gaoyi County Housing Construction Bureau specifically signed five "Construction Project Construction Contracts" involving five local road projects. At present, the relevant projects have been completed and delivered.
According to the contract, the total price of the five projects was nearly 36 million yuan, but until the day of the Pacific company's prosecution, Gaoyi County still had 8.62 million projects to pay.
In this regard, the Gaoyi County Government submitted relevant evidence to the court to prove that the Pacific company's project "has quality problems", but the court did not find it.
In March 2019, Shijiazhuang Intermediate People's Court ruled that Gaoyi County Housing and Urban-rural Construction Bureau will pay the remaining more than 8 million engineering funds to Pacific Company within 30 days from the effective date of the judgment and pay liquidated damages in accordance with corresponding standards. At the same time, the Gaoyi County Government assumes joint and several liability for the above-mentioned obligation to pay for the remaining projects.
Subsequently, the Housing Construction Bureau of Gaoyi County appealed to the Hebei Higher People's Court.
Surging News saw from the relevant judgment of the Hebei Provincial High Court that the Housing and Urban-rural Construction Bureau of Gaoyi County still believes that there is a problem with the quality of the project and that the maintenance cost should be deducted from the project funds.
Hebei Provincial High Court did not support this ground of appeal, because Gaoyi County Housing Construction Bureau provided relevant evidence, failed to prove that the quality problem was caused by the unqualified construction of Pacific Company, and failed to prove that the related maintenance costs were related to the construction of Pacific. .
The Hebei Provincial High Court issued a judgment in August 2019, dismissing the appeal and upholding the original judgment.
However, until the beginning of May this year, the Pacific company reported to Peng Mei News that the final judgment has been issued for more than half a year, and so far no engineering funds have been received.
