The family claims that HBO violated a 1992 agreement where the company was granted the rights to broadcast a recorded concert with Michael Jackson. Under the contract, HBO was not allowed to make any condescending comments about Jackson, or in any way damage his public confidence. BIllboard writes that the contract contained a clause that all offenses against it should be dealt with in arbitration.
