Munich (dpa) - The public prosecutor's office waived an appeal after the judgment of the Munich Regional Court against Erfurt doping doctor Mark S.
This was stated by Chief Public Prosecutor Kai Gräber in an interview with the “Frankfurter Allgemeine Zeitung” (Tuesday edition).
The doctor's lawyer wants to appeal to the Federal Court of Justice (BGH).
Mark S. was sentenced to four years and ten months in prison on January 15 for years of blood doping to athletes and dangerous bodily harm.
He was also banned from working for three years.
“With a little distance I can say that the public prosecutor's office will not go into an appeal.
The verdict was a little below the prosecution's requests for all of the accused, but not to an extent that seems inappropriate, "said Gräber of the" FAZ ".
The presiding judge had found the right words in her verdict.
There is no reason to appeal.
Mark S.'s lawyer, Juri Goldstein, had told the German Press Agency that there had been a “serious violation” of the principle of fair trial.
The BGH in Karlsruhe must decide whether procedural errors were made before the Munich II regional court.
