Common front against the Catalan regulation that limits tourist apartments. The Catalan Federation of Tourist Apartments (Federatur) takes before the Constitutional Court the decree law of the Generalitat that regulates the sector, approved on December 20 in the Parliament.

Specifically, it has joined the appeal that the PP has presented to the High Court regarding the regulation promoted by the ERC Government with the support of the PSC in the Catalan Chamber.

In fact, the appeal was presented on Tuesday and "highlights the abuse that is done by the Government of dictating regulations that take the form of decree laws."

"There cannot be an urgent and extraordinary need if a subsequent development of the urban planning of each municipality is required and a period of 5 years is given to do so," Federatur added.

The appeal also highlights "the violation of the constitutional principle of legal certainty and how the limitation on the granting of licenses for the exercise of the activity affects the right to property."

The president of Federatur, David Riba, has assessed that the definition of the requirements to be on this list are "imprecise and are exempt from technical criteria."

In an interview with this medium, Riba lamented the effects of the new Catalan regulation: "Barcelona may lose large fairs such as Mobile or ISE with the new law against tourist apartments."

With the new decree, the regime of

prior urban planning license for terms of five years (currently an initial declaration of responsibility is sufficient to operate without a time limit) will be mandatory in the 140 municipalities included in the category of

stressed market (where there is a shortage of supply and the price of the rental or mortgage is disproportionate to the average income).

On the other hand, the town councils will decide the maximum number of homes for tourist use, that is, the limit established by the Government of 10 per 100 inhabitants will be eliminated.
