This is one of the classic frauds against which the Urssaf services fight daily.

Last year, the agents of Midi-Pyrénées in charge of the fight against concealed work thus recovered companies for 38.15 million euros in contributions.

An amount never reached, up 30% compared to 2020, and which is explained in particular by better targeting of controls.

“Five years ago, we were recovering 17 million euros.

Those who cheat, we are going to look for them today more intensively.

Today we are working on targeted plans, data-mining.

But we also intervene on the ground during checks in partnership with the gendarmerie, the police or the labor inspectorate, in particular on sports meetings concerning safety or on construction sites for the construction sector", explains Jean Dokhelar, the director regional body of which about twenty inspectors work on these issues on a daily basis.

If the methods of the Urssaf have evolved, those of the fraudsters too.

“We are falling more and more into a legal guise, the appearance of legality is there.

Ten years ago, you had structures where some of the employees were not registered.

It hardly exists any more”, notes the manager, who recalls that “the contributions and contributions are used to finance all that is expenditure of health and pensions”.

The status of autoentrepreneur in the viewfinder

Last year, its teams decided to take a close look at a status that is the source of many irregularities: autoentrepreneurs, who today represent around 80% of business creators each year.

And many of them have this status in a flourishing field: real estate.

“We have made a specific plan for real estate agents, many of whom are self-employed.

There is a 40% fraud rate: that is to say that 40% of them under-declared or did not declare their income.

The legislator has given us tools and the possibility of looking at bank accounts where we can see the discrepancies.

In these cases, the real estate agency they work with is asked if it has been vigilant.

If we find that this is not the case, we can turn against it out of solidarity, ”underlines Nicolas Prades, inspector at Urssaf.

These fraud-fighting actions often end up in court.

In 2021, 71 cases thus resulted in convictions, for a cumulative amount of 5.9 million euros in civil interests for the benefit of Urssaf Midi-Pyrénées.
