AI (Artificial Intelligence) painting is on fire!

Just enter a few keywords, you can generate a beautiful painting in tens of seconds, and you can adjust different schemes according to the user's preferred style of painting.

2022 is called "the first year of AI drawing", and ordinary people also start to try AI drawing.

However, AI painting also brings disputes such as copyright ownership.

Industry experts said that how to determine the copyright ownership of works generated by AI painting tools is still blank in my country's legal and normative system, but the introduction of normative documents in the future is the general trend.

You can also "paint" a masterpiece with zero foundation

Under the blue sky, the big white clouds are rolling like waves, the vast mountains in the distance, and the flocks of sheep running wild on the grassland in the distance... Recently, Hu Liang, a citizen who has never learned to draw, shared it in the circle of friends. One of my "paintings" surprised my friends.

And this "painting" comes from the AI painting platform.

Since the beginning of this year, AI painting platforms have been on the rise.

In foreign countries, Meta, Google, Microsoft, etc. have layouts, and platforms such as Midjourney and Disco Diffusion were born.

In China, Baidu took the lead in launching Wenxin Yige, and platforms such as Inceptionist, 6pen, and TIAMAT are also very popular.

When a sentence can be turned into a painting, AI painting has become popular among ordinary people from the professional circle, and has become the traffic password of social platforms.

Data from a third-party monitoring platform shows that in the past 30 days, Xiaohongshu's "AI painting" has added 64,800 new notes and interactions, making it the number one buzzword; the short video about "AI painting" on Douyin has the highest number of likes exceeding 52.2 Wan; there are also many bloggers posting tutorials on AI painting on video websites such as Station B.

The extremely low threshold for use is the main reason why AI painting attracts ordinary people.

As of now, most AI painting platforms are free for users to use.

Players test the water painting realization path

As the popularity of AI painting has increased, players have begun to explore the possibility of using it to make money and generate income. The most direct way to realize it is to sell pictures.

"The AI painting is 2 yuan once, and the pictures will be produced in batches according to your description, and three better ones will be selected. You can choose one. If you need to beautify the details later, you will be charged an additional 8 yuan for each." Designer Style Han (pseudonym) told reporters that nearly a month after receiving the order, more than 80 people have customized pictures on his hands.

There are also some "painting laymen" who directly sell their own AI finished products.

On the Ali auction platform, the reporter saw that some people auctioned their AI paintings, with prices ranging from 88 yuan to 288 yuan.

One of them, "Full House Romance" priced at 88 yuan, showed 4,531 onlookers and 33 sales.

In addition to selling works, some people directly sell the description keywords used to generate works, such as "Midjourney keyword 20 yuan 2500 sets" "Disco Diffusion keyword with parameter 38.8 yuan" and so on.

"It is mainly foreign AI painting platforms that need to buy keywords." Tu Rui, who is well-known on Weibo and often orders novel illustrations, told reporters that compared with domestic platforms, pictures can be generated simply by describing in Chinese words. The platform also requires users to add advanced parameters, comment codes, etc. on the basis of keywords.

On the short video platform, there are still many accounts depicting the "money scene" of AI painting "making hundreds of dollars a day" to beginners, and selling related courses, with prices ranging from 19.9 yuan to 299 yuan.

However, most of these courses are currently only selling in single digits.

The ownership of AI painting copyright is to be clarified

In August, the AI painting "Space Opera House" won the championship in the digital art category at an art fair in the United States, sparking heated discussions.

"Is my job going to be taken away by artificial intelligence?" Tu Rui said with emotion. Recently, AI painting has caused heated discussions in the circle of painters.

The reporter noticed that at present, the actual effect of AI painting in the painting industry is mixed.

Some cartoonists said with emotion: "The function is too powerful, it can help me quickly 'pinch' into more than a dozen two-dimensional avatars"; but some netizens commented after trial: "The details of many scenes are too rough, there is no aesthetic feeling, and it is not easy to simply imitate , let alone touching and appealing.”

A number of professional painters have made it clear that at present, AI painting is far from replacing human painters.

However, there are already WeChat public account authors who took the lead in eating "crabs": using AI painting to fully replace paid pictures as article illustrations, and even providing AI painting production to publishers as the cover of upcoming books.

Will this involve copyright issues?

Can AI painting be directly commercialized?

Wenxin Yige, an AI art and creative assistance platform, said that platform services are in the cutting-edge exploration stage, and works cannot be used for commercial purposes.

The 6pen platform said that the copyright of all the pictures generated by users using AI painting belongs to the users, and the platform does not reserve copyright.

How to determine the copyright ownership of works generated by AI painting is still blank in my country's legal and normative system.

Zhao Zhanzhan, deputy director of Beijing Yunjia Law Firm, believes that the copyright of AI paintings should generally belong to the software producers.

Xiao Sa, senior partner of Beijing Dentons Law Firm, said that although the law is lagging behind, it is a general trend to issue various normative documents for AI-generated art in the future. Opinion Draft)” is a recent representative legislative draft in the field of AI generative art.
