The National High Court has issued an agreement to execute the judgment ordering the Tax Agency to return to Telefónica

1,315 million euros

for the amounts paid in excess in 2009 and 2010, plus default interest, as reported by the operator.

Telefónica has informed the National Securities Market Commission (CNMV) on Tuesday that it has been notified by the National Court of this judgment execution agreement, which derives from the one issued on October 29, 2021, by which the courts confirmed the criteria applied by the operator when paying taxes.

The company will receive 790 million euros for the taxes paid during those years and, given the time that the administrative and judicial process has lasted,

another 526 million euros for default interest.

The litigation has thus been resolved in favor of the criteria applied for the use of negative tax bases and deductions maintained by Telefónica in relation to the liquidation agreements derived from

the inspection of corporate tax for the years 2008 to 2011.
