According to a court document cited by Reuters on September 15 local time, Musk accused Twitter of concealing serious flaws in its data security to commit fraud, and said he would end a $44 billion acquisition of Twitter.

According to reports, Musk revised his counterclaim against Twitter this time, adopting the allegations of Twitter's former security chief Peiter Zatko that Twitter put interests over security, and said Twitter's Conduct constitutes fraud and breach of contract.

Musk said Twitter hid from him that it was not complying with a 2011 agreement with the Federal Trade Commission over user data, and asked a Delaware judge to rule that he was not obligated to complete the deal.

  It is reported that Twitter wants a judge to order Musk to buy the company for $54.20 per share.

The five-day trial is scheduled to begin on October 17.
