Article 1 In order to regulate the Internet pop-up information push service, safeguard national security and public interests, protect the legitimate rights and interests of citizens, legal persons and other organizations, and promote the healthy and orderly development of the industry, in accordance with the Cybersecurity Law of the People's Republic of China and the People's Republic of China These regulations are formulated in accordance with the Law of the Republic of China on the Protection of Minors, the Advertising Law of the People's Republic of China, the Measures for the Administration of Internet Information Services, the Regulations on the Administration of Internet News Information Services, and the Regulations on the Ecological Governance of Network Information Content.

  Article 2 These Provisions shall apply to the provision of Internet pop-up information push services within the territory of the People's Republic of China.

  The term “Internet pop-up window information push service” as mentioned in these Provisions refers to the information push service provided to Internet users in the form of pop-up message windows through operating systems, application software, websites, etc.

  The term "Internet pop-up window information push service provider" as mentioned in these Provisions refers to an organization or individual that provides Internet pop-up window information push service.

  Article 3 The provision of Internet pop-up information push services shall abide by the Constitution, laws and administrative regulations, carry forward the core socialist values, adhere to the correct political direction, public opinion orientation and value orientation, and maintain a clean cyberspace.

  Article 4 Internet pop-up information push service providers shall implement the main responsibility for information content management, and establish and improve management systems such as information content review, ecological governance, data security, personal information protection, and protection of minors.

  Article 5 Those who provide Internet pop-up information push services shall abide by the following requirements:

  (1) Do not push illegal and bad information as stipulated in the "Regulations on the Ecological Governance of Network Information Content", especially malicious speculation about entertainment gossip, scandal privacy, extravagant display of wealth, judging ugly and pretending to be ugly and other content that violates public order and good customs, and must not use malicious speculation as the purpose , which is associated with a topic and pushes relevant old news in a centralized manner;

  (2) Those who have not obtained the Internet news information service license shall not push news information through pop-up windows. The information pushed through pop-up windows involves other Internet information services, and shall be subject to the examination and approval of the relevant competent authorities according to law or obtain relevant licenses, shall be subject to examination and approval by the relevant competent authorities or obtain relevant licenses;

  (3) When pushing news information through pop-up windows, it shall strictly follow the "List of Sources of Internet News Information" issued by the Cyberspace Administration of China, shall not reprint beyond the scope, shall not distort or tamper with the original meaning of the title and the content of news information, and ensure that the source of news information can be retrospect;

  (4) Improve the diversity of information pushed through pop-up windows, scientifically set the proportion of news information and content in vertical fields, and reflect the mainstream values ​​of positivity, health and improvement. Do not focus on pushing and hyping social hot and sensitive events, vicious cases, disasters, etc. panic;

  (5) Improve the management specifications for the content of pop-up information push, improve the workflow of information screening, editing, and push, etc., and equip the audit force commensurate with the scale of the service, and strengthen the audit of pop-up information content;

  (6) Protect the rights and interests of users, clearly inform users of the specific form, content frequency, and cancellation channels of the pop-up information push service through service agreements, etc., fully consider the user experience, scientifically plan the push frequency, and shall not conduct unreasonable actions against ordinary users and member users. It shall not interfere or influence the user to close the pop-up window in any form, and the pop-up window information shall clearly indicate the identity of the pop-up window information push service provider;

  (7) Do not set up algorithm models that induce users to indulge in addiction, excessive consumption, etc. that violate laws and regulations or violate ethics; do not use algorithms to maliciously block information, make excessive recommendations, etc.; do not use algorithms to create portraits of minor users and push them information that may affect their physical and mental health;

  (8) If the pop-up window pushes advertising information, it should be identifiable, and clearly marked with "advertising" and a closing sign to ensure that the pop-up window advertisement is closed with one click;

  (9) Information such as third-party links, QR codes, etc. that maliciously divert traffic to, shall not be presented by means of pop-up information push, and users shall not be induced to click through the pop-up information push service to implement traffic fraud or traffic hijacking.

  Article 6 Internet pop-up information push service providers shall consciously accept social supervision, set up convenient complaints and reporting portals, and promptly handle public complaints and reports on pop-up information push services.

  Article 7 Encourage and guide Internet industry organizations to establish and improve industry standards for Internet pop-up information push services, and guide the healthy and orderly development of the industry.

  Article 8 The cybersecurity and informatization department, together with the telecommunications authority, market supervision department and other relevant departments, shall establish and improve working mechanisms such as collaborative supervision, and supervise and guide Internet pop-up information push service providers to provide services in accordance with laws and regulations.

  Article 9 Where Internet pop-up information push service providers violate these Provisions, relevant departments such as the network information department, the competent telecommunications department, and the market supervision department shall deal with them within the scope of their duties in accordance with relevant laws and regulations.

  Article 10 These regulations shall come into force on September 30, 2022.
