China News Service, July 25. A civil judgment of the second instance published recently by the Beijing Court Trial Information Network shows that Air China Co., Ltd. (hereinafter referred to as "Air China") sued a captain who resigned from Air China in 2020. It is required to pay 5.33 million yuan for training fees and 5.33 million yuan for liquidated damages, totaling 10.66 million yuan.

Air China sued that it would cost the airline at least 6 million to 8 million yuan to train a captain.

In the first instance, the court held that the pilots were professional and special, and belonged to high-skilled talents, requiring a long process of ability development and continuous ability maintenance, and the captain should pay Air China's loss of training fees.

At the same time, Air China's request for payment of liquidated damages shall not be supported.

The first-instance court ruled that the captain should pay Air China's training fee of 2.1 million yuan.

The second-instance judgment shows that in the second-instance, both parties did not submit new evidence, and the second-instance upheld the original judgment.
