Amending some provisions of the decree regulating the ownership of industrial and commercial lands granted in Dubai

His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, may God protect him, in his capacity as Ruler of the Emirate of Dubai, issued Decree No. (25) of 2022 amending some provisions of Decree No. (4) of 2010 regulating the ownership of granted industrial and commercial lands. in the Emirate of Dubai.

The amendment included the replacement of the texts of the first and second articles of Decree No. (4) of 2010, where the first article included the definitions contained in the decree, while the second article is concerned with the ownership of granted lands, provided that the new decree is published in the Official Gazette, and is implemented from the date of its publication.

According to the new text of the first article of the decree, the definitions included the Department of Lands and Properties, and “granted land”, which is: the plot of land allocated for industrial or commercial purposes, which is granted the right of usufruct to citizens, including: the plots of land for which a disposal order has been issued, and the plots of land that have devolved To others by inheritance, assignment, gift or consideration.

The article also included the definition of "the beneficiary" as a citizen who holds the citizenship of the United Arab Emirates, who has acquired the granted land.

The definition of a “real estate project” is a project to develop the granted land or any part of it, build the infrastructure and common service facilities in it, divide it into several lands for the purpose of benefiting from them, and construct multi-storey buildings or complexes for residential, commercial or mixed purposes, which the beneficiary wishes to develop. According to the plans approved by the concerned authorities in the Emirate of Dubai.

The new text of Article Two of the decree authorized, at the request of the beneficiary, to own the land granted to him in absolute ownership, free from any restriction related to its use, exploitation or disposal, provided that this land is a completed real estate project or under construction, in accordance with the controls and conditions established by the Department of Lands and Properties in this regard.
