  [Explanation] It is reported that Article 30 of the "Employment Promotion Law" stipulates that an employer shall not refuse to hire a person on the grounds that he is a carrier of an infectious disease pathogen.

In this regard, the lawyer believes that the behavior of the employer to reject the positive recovery of the new crown constitutes employment discrimination against job seekers.

At the same time, judging from the existing medical conclusions, those who have recovered from the new crown can be regarded as healthy people, and the behavior of the employer clearly violates the "Employment Promotion Law".

  The first problem is that it should be a relatively obvious violation of the "Employment Promotion Law of the People's Republic of China". The rejection of this job seeker with a positive recovery record should constitute employment discrimination.

  The second question, according to the current medical conclusions, is that this positive recovery person can actually be regarded as a healthy population, not a carrier of infectious disease pathogens, so from this point of view, if the employer refuses to hire a positive recovery person , or to write "do not enter the cabin" on the recruitment information, which is a relatively obvious employment discrimination.

In this regard, lawyers believe that in addition to job seekers' own rights protection, the key to improving such situations lies in the change of social awareness.
