High point in the dispute between SFR and Orange over the installation of a Huawei 5G network in Reunion.
After several twists and turns, the Council of State has just definitively authorized SFR to deploy its network on the island, reveals

In July 2021, SFR was authorized by the government to launch its 5G network in Reunion with Huawei equipment.
Orange immediately reacted by attacking the State, yet its main shareholder, in summary proceedings before the administrative court.
And for good reason: in 2020, the operator was himself refused the installation of its 5G network via the Chinese company.
A case judged on form
The administrative court of Paris had decided in favor of Orange, by suspending the authorization given by the State to SFR.
The judges then justified their decision by explaining that the government had "disregarded the principles of equality and free competition" and that its decision could "sustainably affect the competitive structure of the mobile telephony market" on the island.
SFR had appealed against this decision before the Council of State.
This time, the operator in the red square won the case, the highest court having only examined the form and not the substance of the case.
The Council of State thus considered that Orange was not legitimate to contest a decision which had not been rendered against it.
