But the other party believes that this is a public parking space, and there is no such thing as occupancy, first come, first stop.

  Baoneng mansion again in parking space dispute

  Baoneng Mansion is located in the Xiangmihu area of ​​Futian, Shenzhen, which is a high-end community developed by Baoneng Real Estate.

  It is understood that the project includes commercial housing, apartments and talent housing.

The first and second phases are residences, which will be handed over and occupied at the end of 2018. The main units are 110-230 square meters with three to five rooms.

The third phase of the project is a business apartment - Baoneng Mansion V-HOUSE, located in Buildings 5A and 5B. The main unit is a one-bedroom of 73-98 square meters. It has entered the market in the second half of 2020 and will be handed over to move in at the beginning of this year.

  The residences and apartments of the project are managed separately, but the underground parking lot in the two areas is shared.

Previously, Baoneng Mansion could only enter the parking lot on the negative three floors, and the parking lots on the negative first floor and the negative second floor were not open.

The property even welded the rolling shutters on the negative first and negative second floors, causing dissatisfaction among the owners of the residential area.

  The parking space dispute stemmed from Baoneng's sales strategy of "buying an apartment and sending a parking space". The contract shows that "Baoneng Mansion will give the owner the right to use the parking space for a specified number of years free of charge".

It is worth noting that the developer promised to buy the apartment and give away the right to use the parking space, but the gift is the parking space under the residential area.

The female car owner involved was the owner of the apartment area, claiming that "buying an apartment gives you a parking space, which is equivalent to buying a fixed parking space".

  Some owners said that after the occupancy in 2018, the parking space was very tight, and the developer also called to inform that 400,000 yuan can buy a parking space.

Before this dispute, the property management company had twice blocked some parking spaces and installed floor locks as "special parking spaces" only for the owners of the apartment complex. Among them, the parking space of the female car owner involved was included, which intensified the conflict.

At present, residential area owners hope that apartments can move "dedicated parking spaces" in residential areas to apartment parking lots, so as to avoid more disputes.

At that time, there was a notice that the parking spaces originally used by the owners were given to the shopping mall on the first floor, and part of the parking spaces on the other floor would be sold and the rest would be allocated to the kindergarten. The promised parking space ratio changed from 2:1 to 0.8:1. The owners exploded.

  The surrounding parking spaces are also very tight

  The reporter learned from real estate agents near Baoneng Mansion that there are many old communities around the area, and parking has been tight for a long time. However, due to the rare degree of degrees, the housing prices in the area are not low. Ten million yuan.

  Real estate agents told reporters that most of the Baoneng mansions are large units of more than 100 square meters, and the only two-bedroom units of 80 square meters are less than 20 units.

The minimum area of ​​second-hand houses currently listed is 108 square meters of three-bedroom. Apart from the guide price of about 140,000 yuan, the actual listed transaction price is about 160,000 to 70,000 yuan. That is to say, the total price of the smallest unit that can be sold is about 18 million yuan. A proper mansion.

  The reporter saw that most of the buildings around the Baoneng Mansion are "old and broken" buildings built in the last century, many of which are old and worn, and the downstairs are dilapidated.

  Shenzhen parking space management documents have not been officially released

  In 2013, in response to the dispute over the sale of parking spaces in a community in Shekou, Shenzhen officials made a clear statement at that time: "In order to avoid further disputes, all developers are required to stop selling parking spaces."

  In December 2014, the "Shenzhen Real Estate Development Project Parking Space Construction and Disciplinary Management Measures (Draft for Comment)" was released. The measures plan to stipulate that Shenzhen will classify and confirm the right parking spaces, and it is the first in the country to allocate two kinds of construction and addition.

The built-in parking spaces are owned by all the owners and are prohibited from buying and selling. Additional parking spaces are owned by the developers and can be leased and sold conditionally.

The former is agreed to be owned by all the owners of the development project, while the latter can be agreed to be owned by the development enterprise, but can only be sold or leased to the owners of the project.
