A particularly buoyant sector, personal services employ 1.4 million people each year and benefit 3.4 million individuals, according to figures from the Department of Research, Studies and Statistics (Dares) .

It is therefore not surprising that their legislative framework is in perpetual transformation.

However, since the end of 2021, significant changes have been made.

A salary increase for the associative sector

Good news for home helpers working in the voluntary sector.

Since October 1, 2021, these employees, but also those of home support assistance (SAAD) or home nursing services (SSIAD), can claim a salary increase of 13 to 15%.

This is calculated according to seniority, the status of the professional, diplomas but also constraints related to the activity, and can reach 300 euros gross per month.

For example, for a home help with ten years of seniority, this would mean a salary increase of 227 euros net monthly.

According to the government, this boost benefits 210,000 employees in France.

Be careful, however: employees of private companies in the sector are not concerned.

A new collective agreement

Another novelty, since January 1, 2022, a new collective agreement applies for all personal services and therefore contains the latest rules of labor law to be applied for both employers and employees.

This text replaces two other agreements: the collective agreement for employees of private employers who hire a life assistant, a family employee, a child minder at their home, as well as the collective agreement for childminders for individuals who hire a childminder.

In practice, it simplifies the procedures for individual employers who can now mandate a third-party organization to guarantee the effectiveness of their employees' rights.

On the employees' side, this collective agreement gives them new social rights, such as the unification of guarantees in terms of providence (critical illness guarantee, education annuity, death capital), a retirement bonus, social activities and cultural…

For individuals who already employed a home helper and who need to update themselves, it suffices to offer their employee an amendment to the employment contract which takes up the new features of the agreement, unless, of course, the latter already provided for more favorable terms.

A simplified tax credit

Finally, the legislator has simplified the tax credit that individual employers can benefit from.

Because by using home services, it is possible to deduct 50% of expenses incurred during the year, within the limit of a ceiling of 12,000 euros per year, when completing your annual income tax return.

Until now, you had to make an advance and wait to be reimbursed for part of the sums paid.

From now on, individual employers can request to benefit from an immediate advance, that is to say that the tax credit will be immediately deducted each month from the amounts due to the employee, within the framework of the Cesu + service.
