The judge of the National High Court that investigates the alleged illicit assignments by BBVA to the business group of Commissioner José Manuel Villarejo has refused to call the president of BBVA,

Carlos Torres

, as a witness , but has agreed to question the former CEO of the bank as such. and current president of Caixabank,

José Ignacio Goirigolzarri

.

In an order of this same Thursday, the reinforcement magistrate of the Central Court of Instruction Number 6,

Joaquín Gadea

, denies Torres' testimony, raised among others by the private accusation that

Luis del Rivero

exercises , although he admits the request of the Prosecutor's Office Anti-corruption of interrogating Goirigolzarri and that of the accusation of also serving Ayuso, according to Europa Press

Gadra recalls in his car that he was interested in Torres' testimonial in relation to the information provided by BBVA's Director of Communications,

Pablo García Tobin

and, specifically, to find out if he knew of the existence of the Google Drive folder in which some documents were hidden.

The instructor clarifies, as stated by the prosecutor, that to clarify whether Torres was aware of the information uploaded to Google Drive, you can go to those who had access to it, without having to resort to him.

"There being no evidence to support that the Torres had had access to the Google Drive folder, the request lacks any usefulness and relevance," he explains.

Gadea understands that, from the analysis of the proceedings carried out to date and the study of the material contained in the proceedings, no evidence has been found to support that Torres "issued any directive, instruction or order to hide documents that affected the procedure , so no link is detected, beyond their hierarchical position or in the entity, that justifies the call".

On the other hand, the judge does consider it useful and necessary to appoint Goirigolzarri as a witness, since, from the analysis carried out of the internal documentation of CENYT --the Villarejo business group-- on the 'Trampa' project,

it is essential to listen to the person who was CEO of BBVA during 2004 and 2005

"since there are indications that he had access to the 'Trampa II' report, as well as later to 'Trampa I', and that, although he thought it might be criminal, he did not dare to discuss it with Francisco González ", the then president of the bank.

In addition, Gadea accepts the statement as a witness of the former director of Communication, in view of the new data collected since his previous statement in November 2019.
