13 people banned for life

  On April 22, the Chongqing Banking and Insurance Regulatory Bureau issued 5 pieces of information on administrative punishments. A total of 11 former insurance practitioners from 5 life insurance companies were banned from entering the insurance industry for life, all because of the crime of illegally absorbing public deposits during the insurance business. behavior, and directly responsible for the problem of inadequate internal management of the organization.

  According to the information previously released by the Chongqing Banking and Insurance Regulatory Bureau, the above-mentioned personnel were all involved in helping Chongqing Shengyun Moody Equity Investment Fund Management Co., Ltd., in the name of selling funds, to illegally raise funds and absorb public deposits from 2014 to 2017.   At the same time, according to the administrative penalty decision of the Shanxi Banking and Insurance Regulatory Bureau on April 1, Zhang Moumou, who was then the manager of the business department of a health insurance company's Taiyuan central branch, was banned from entering the insurance industry for life.

According to public information, Zhang Moumou defrauded the ID cards, bank cards and passwords of 3 customers, signed a power of attorney on behalf of the customers without the knowledge of the customers, applied for the policy loan, and took the loan for his own use, involving a total of 5 policies. The insurance premium is 452,700 yuan, and the loan amount is 234,000 yuan.

In November 2020, Zhang Moumou was sentenced by the People's Court of Jiancao District, Taiyuan City, Shanxi Province for the crime of loan fraud and fraud.

  Another person who was banned from entering the insurance industry for life was Li Moumou, the former back-office officer of the Lanxian branch of a personal insurance company at the time.

According to the administrative penalty decision issued by the Lvliang Supervision Branch of the China Banking and Insurance Regulatory Commission on April 1, Li Moumou has violated laws and regulations by deceiving insurance applicants, insureds or beneficiaries and embezzling insurance premiums.

After investigation, from April 2015 to July 2019, Li Moumou took measures such as intercepting insurance application forms, stamping special invoices with fake official seals, and duplicating insurance contracts to defraud customers to apply for insurance, and embezzled 33 insurance premiums with a total amount of 5.3789 million yuan. Yuan.

Irregular or even more serious problem of insurance sales behavior is the chronic disease of the industry. The transformation of the industry will be promoted more vigorously.

  From the perspective of insurance companies, in recent years, they have also strengthened the management of illegal behaviors of some sales personnel, and cooperated with the public security organs to crack down on the phenomenon of "black production" in the industry.

But from another point of view, some insurance companies have a conflicted mentality, and they also "turn a blind eye to the illegal behaviors that can bring business income". Therefore, to regulate the development of the whole industry, we cannot rely on the independent management of insurance companies. Must rely on the role of external regulatory forces.

"Driving without a license" is not a case

  A case of "driving without a license" surfaced in April's insurance industry fines.

From the perspective of the entire industry, it is not a case, and it is also one of the problems that the regulatory agencies are focusing on.

  The administrative penalty information released by the Heilongjiang Banking and Insurance Regulatory Bureau on April 18 shows that Harbin Anji Rongzhan Automobile Sales and Service Co., Ltd. engaged in insurance agency business without obtaining the "Concurrent Insurance Agency License".

The China Banking and Insurance Regulatory Bureau decided to confiscate the illegal income of the auto sales service company of 82,400 yuan, and imposed a fine of twice the illegal income, with a total fine of 247,200 yuan.

  Earlier this year, the Beijing Banking and Insurance Regulatory Bureau issued an announcement saying that some unlicensed "insurance intermediaries" were suspected of carrying out illegal activities.

The China Banking and Insurance Regulatory Bureau stated that some institutions that have not been licensed or filed for insurance intermediary business, but whose names contain the words "insurance agency, brokerage, and adjustment" are suspected of illegally conducting illegal activities in the name of insurance, insurance intermediary, dividend wealth management, agency rights protection, etc. Fundraising, fraud, misleading or inciting insurance customers to surrender their policies abnormally and other illegal activities have caused property losses to the people, and some cases have been filed by the public security organs for investigation.

The China Banking and Insurance Regulatory Bureau solemnly reminded that, according to the reform spirit of "license before license", insurance agencies and insurance brokerage companies should apply for business licenses and obtain insurance intermediary licenses after obtaining business licenses; insurance adjustment companies should obtain business licenses after obtaining business licenses.   Industry insiders said that auto sales agencies and some Internet companies have channel resources to facilitate insurance agency sales, but they must obtain corresponding qualifications.   In addition to "unlicensed driving", there are also insurance companies that have been suspended from new business for one year because their business "created out of nothing".

According to the administrative punishment information released by the Xinjiang Banking and Insurance Regulatory Bureau on April 2, a marketing service department of a large property insurance company Shihezi City Branch passed the preparation of false underwriting materials in 2018, with a false underwriting area of ​​9,160 mu; 10, with a total compensation amount of 1.2927 million yuan.

At the same time, it compiled 22 false agricultural insurance co-insurers related information, falsely listed work expenses totaling 406,670 yuan.

For the above violations, the Xinjiang Banking and Insurance Regulatory Bureau decided to fine the company 840,000 yuan and stop accepting new agricultural insurance business for one year.

  Guo Zhenhua said that government subsidies for policy-based agricultural insurance are very strong, and insurance companies engage in false underwriting and false claims in order to obtain government subsidies.

In fact, the problem of agricultural insurance also exists in other fields with government subsidies, such as social security. At present, both the management of insurance companies and the regulatory agencies lack systematic and effective methods. It is necessary to conduct special evaluations on the efficiency of government insurance premiums. The crackdown on violations may be conducive to improving false underwriting, claims and other issues.
