Representative members appeal:

platforms with rampant online sales of pirated books should take responsibility

"If we don't crack down on the pirated book industry chain, it will have a negative impact on the world outlook and values of the younger generation," said Zhu Yongxin, member of the Standing Committee of the National Committee of the Chinese People's Political Consultative Conference and deputy secretary-general.

Last year, Zhu Yongxin learned in a survey that an institution purchased books on an online platform. Among the 199 books identified, only 18 were genuine books, and the rest were pirated.

Lin Yang, a member of the National Committee of the Chinese People's Political Consultative Conference, a member of the Democratic Progressive Central Committee, and the former editor-in-chief of China National Art Publishing House, believes that nowadays pirated books are gradually being sold on online platforms, and the situation is rampant.

During his research, he learned that in 2019, the infringement losses suffered by a publishing group in one year were about 300 million to 500 million yuan.

Another publishing house will set up a thief commissioner in 2021 to combat piracy online, and a total of more than 10,000 pirated book links have been removed from the shelves.

Zhu Yongxin said that some people think that pirated books are only infringing on the interests of a few people such as publishers and authors, "in fact, they are infringing on the interests of all of us."

He said that because of the influence of pirated books, publishers take piracy factors into account when pricing books, and will set prices higher, even exceeding consumers' expectations.

In order to save costs, many pirated books are printed with inferior ink, which is not conducive to the health of readers.

Lin Yang said that in the face of pirated books, publishers' rights protection is "difficult to provide evidence, long cycle, high cost, and low compensation".

What makes him angry is that many platforms abuse the "safe haven principle", use the mandatory default terms and new technical conditions when users register as shields, evade their own censorship obligations, and prevaricate on the grounds of "don't know whether the content uploaded by users is infringing". , or exempt yourself from responsibility by removing or removing the complained product.

Zhu Yongxin once specifically consulted relevant people in the publishing field. Relevant people told him that cracking down on piracy, especially online pirated books, should be as severe as the crackdown on pirated CD production lines.

If a pirated production line is found, it will be confiscated directly.

For those who report, they will also be rewarded with 10% of the value of the production line.

Zhu Yongxin suggested that the relevant departments should carry out special rectification actions in view of the low illegal cost of pirated books and the difficulty of rights protection on the e-commerce platform, especially to clarify the legal responsibility of the e-commerce platform after the third-party partners sell pirated books.

According to the protection mode of film and television works, the copyright management department shall publish the copyright protection warning list of key books and related rights information, and strengthen the copyright protection of key books.

Zhu Yongxin also suggested establishing and improving the credit information sharing system of all e-commerce platforms on the entire network.

Take "good credit" as an important factor for algorithm recommendation, and "one-vote veto" for third-party partners with bad credit records.

Lin Yang also believes that it is necessary to increase the penalties for the printers and sellers of pirated books.

He also wants e-commerce platforms to adequately scrutinize sales links and limit questionable items that are significantly below market prices.

He also suggested that the platform directly freeze the platform account funds of pirated book sellers, and strictly limit the establishment of new links for shops with pirated sales taint.
