Presentation The new CGPJ report on the Government's law: "Housing is a matter of regional ownership"
The
General Council of the Judiciary (CGPJ)
has approved this Thursday by 15 votes in favor and six against the report critical of the Preliminary Project of the Law on the Right to Housing of the coalition government, according to legal sources reported to EL MUNDO.
In the aforementioned report, which is mandatory but not binding, the governing body of the judges questions the invasion of autonomous powers incurred by the legal draft as well as the interference in the right to private property of the new law.
The document approved this Thursday by the Council, a presentation by the members

states that "housing is a matter of regional ownership, by virtue of article 18.1.3 of the Spanish Constitution and the statutes of autonomy. The The core of its regulation and the public policies aimed at making effective the right of article 47 of the Constitution corresponds to each of the autonomous communities that exercise their powers in accordance with the majority political orientation existing in them and, without prejudice, to the powers of the State that affect said matter".
On the other hand, the CGPJ maintains that the provision on price containment measures in the regulation of housing leases of the new Law "being a constitutionally sensitive issue, has a
limited scope and a cumbersome content
. Born to combat the effects of the pandemic, its maintenance when it has declined, may not be adequate".
Likewise, the governing body of the judges criticizes that "the preliminary bill sets forth the
right to decent housing
, but obviously does not regulate it, except in certain aspects that are open to administrative intervention with the consequence of a certain distortion of categories and concepts established in Civil Law, without sufficient reasons for it being appreciated".
