东莞:共有产权住房取得个人份额3年内不得转让

  1月25日,澎湃新闻从广东省东莞市住房和城乡建设局官网获悉,《东莞市共有产权住房管理办法(第一次征求意见稿)》(简称《征求意见稿》)公开征求意见。

  所谓共有产权住房,是指由政府投资或提供政策优惠支持,按照有关标准筹集建设,面向符合规定条件的对象供应,实行政府与承购人按份共有产权,并限定使用和处分权利的保障性住房。

  按照《征求意见稿》,共有产权住房的筹建方式包括政府组织集中建设;通过“限房价、竞地价、限供应对象”等方式由房地产开发企业集中建设;通过“限房价、控地价、定品质、定配建”等方式在商品住房项目中配建;在城市更新、“三旧”改造项目中配建;收购符合要求的新建商品住房或存量住房;转用符合要求的在建和未销售的经济适用住房、直管公房等;接受捐赠等其他合法途径筹集的住房。

  在选址方面,《征求意见稿》提出,共有产权住房项目选址应当根据国民经济和社会发展规划、国土空间规划等要求,结合城市功能定位、产业布局和需求分布,优先安排在配套设施较为齐全、功能较为完善、需求较为集中的区域。

  按照要求,共有产权住房应当坚持“节能、绿色、环保”的原则。户型设计应紧凑实用,建筑面积原则上不超过120平方米,其中90平方米以下户型不低于80%。

  按照产权比例的划分,共有产权住房由政府指定的接收单位(代持机构)与承购人按份共有。承购人的产权比例原则上不低于50%,按总价的相应比例购买产权,并按普通商品住房交易流程办理预售、合同网签备案和不动产权登记手续。

  销售价格方面,共有产权住房销售价格实行政府指导价,由住房城乡建设部门会同发改部门根据不同的建设筹集方式确定。

  通过“限房价、竞地价、限供应对象”等方式由房地产开发企业集中建设的,销售价格不得高于住宅用地出让文件的限定销售价格。

  According to the regulations, a family can only apply for one set of housing with shared property rights, and enjoy the same public service benefits as settlement and enrollment as residents who purchase commercial housing.

Families who have purchased houses with shared property rights shall not enjoy the housing security policies of Dongguan City, including applying for renting public rental housing, affordable rental housing, receiving rental subsidies, rental concessions, rental subsidies, and rent reduction, etc.

  The "Draft for Comments" shows that the purchaser obtains the individual share of the housing with common property rights within a certain period of time (refer to the implementation of the sales restriction policy of commercial housing in Dongguan, currently 3 years), except for special circumstances (including the purchaser and his spouse and joint If the living children obtain other housing through purchase, inheritance, gift, etc., or the purchaser's debt, breach of contract related agreements, etc. lead to the co-ownership housing being enforced by the court), it cannot be transferred in any form.
