From January 1, 2022, all municipal officials will have to work 35 hours.

But in certain municipalities, certain professions benefit from an exemption which they defend tooth and nail for the arduous nature of their work.

The Minister of Transformation and the Public Service, Amélie de Montchalin, was this morning the guest of Europe 1. She notably returned to the soon-to-be compulsory 35 hours in the public service.

From January 1, 2022, no municipal agent will have to work less, unless there is an exemption.

However, according to a report of the prefects, half of the town halls do not respect the rule and pay 35 hours of the agents who work less.

The minister denounced a form of injustice vis-à-vis other communities and in particular pointed the finger at the town hall of Paris, La Rochelle or Strasbourg, where garbage collectors justify this exceptional treatment.

Unions defend their derogation

Claude is a garbage collector in Strasbourg.

"I work 20 hours a week but we are paid 35 hours," he explains.

It touches "not much, but a little more than the minimum wage", 1,500 € net per month precisely.

He is not the only one to work less than 35 hours a week, as confirmed by Pierre Kuntzmann, the president of the Autonomous Federation of the Territorial Public Service.

"There is a large part of the agents who work less, but it is linked to the arduousness. Garbage collectors who work very early in the morning or people who work very late at night: atypical schedules", he explains. .

And then, for all workers, in the public as in the private sector, there is also a specificity in Alsace and Moselle.

"Madam the Minister must very probably disregard local law. The working time is reduced by two days: the day of Saint-Etienne, December 26, is a public holiday as well as Good Friday", continues the trade unionist.

But these two days less worked do not necessarily explain everything.

The 35 hours per week correspond to 1607 hours per year.

Among municipal officials in Strasbourg, 28 are lacking to comply with the law which will come into force on January 1.
