Now is the time for diversion.

While the courts are always overwhelmed and the delays in justice drag on, everything is done to encourage litigants to settle their disputes outside the courtroom.

Praised for years by professionals, alternative dispute resolution practices are on the rise among individuals.

Not to mention that it is now a mandatory prerequisite for any legal action relating to a civil dispute of less than 5,000 euros, as well as for all neighborhood disputes, without limit of amount.

Faced with the increase in demand, court conciliators (whose consultation is free) are now faced with competition from many paying civil mediators, while arbitration is reserved for disputes between professionals.

However, if recognized players such as notaries or lawyers offer this type of service, there are also specialized internet platforms whose reliability is less verifiable.

The State has therefore decided to discipline this market by launching its Certilis brand.

Guarantee of quality

Open to applications for certification in the first quarter of 2021, this label aims to ensure that the amicable resolution or arbitration process offered by the online service complies with the obligations set by law. These include, among others, the duty to carry out the mission with "competence, diligence, impartiality, independence and with respect for confidentiality", to respect data protection but also to "inform the user in a comprehensible, detailed and personalized on the modalities according to which the amicable resolution is carried out or the arbitration is rendered ”. Certilis prohibits these services from having "as their sole basis an algorithmic or automated processing of personal data". It is therefore a question of providing a real guarantee of quality on the functioning of these platforms.

For the time being, there is no available listing of certified services.

It is therefore when you consult a site that you must check that it has the brand's logo.
