Suspended employees without a valid pass will not have unemployment benefits

, the Minister of Labor, Elisabeth Borne, clearly indicates that employees who will be suspended for not showing a valid health pass will not receive unemployment benefits.

"This is not a breach of contract, so he will not be entitled to unemployment benefits," said the minister. 

"I am aware that the suspension of the employment contract and therefore of the remuneration is difficult for the employee concerned, but the objective is to give him time to comply with his obligation, avoiding a disciplinary sanction", affirmed Elisabeth Thick headed.

"If an employee decided never to fulfill his vaccination obligation, then we would enter into a process of common law, with the possibility of termination of the employment contract," warned the Minister of Labor. 

The personnel concerned by the places where the health pass is requested

Employees in places affected by the extension of the health pass have until August 30 to obtain the famous sesame.

According to the Official Journal, “employees, public officials, volunteers and other people who work in the places, establishments, services or events concerned, when their activity takes place in the spaces and at the times when they are accessible to the public, with the exception of delivery activities and except emergency response ”are concerned. 

In the event of non-presentation of a health pass validated from the beginning of September, these workers will be suspended in order to allow them to comply with the law.

During this suspension, they will be deprived of salary.
