The environmental associations Green League Brandenburg and Nabu, which are opposed to early approval for the construction of the Tesla factory in Grünheide, have again failed in court: the Higher Administrative Court Berlin-Brandenburg (OVG) rejected a so-called hearing complaint on Thursday.
This was confirmed by the lawyer for environmental associations, Thorsten Deppner.
The decision of the court has been submitted to the German Press Agency.
In the complaint, the environmentalists had criticized, among other things, that the court had not given them a sufficient legal hearing.
The court saw a violation of the right to a fair hearing according to the order, however, not shown.
The "Business Insider" had initially reported about it.
In mid-July, the nature conservation associations failed with an urgent application for early approval for the construction of the Tesla factory in Grünheide.
The Higher Administrative Court of Berlin-Brandenburg had rejected a complaint by the associations against a decision of the Administrative Court of Frankfurt (Oder) from June.
This enables Tesla to test systems and units in the foundry, paint shop and body shop, and to build and use tanks for rinsing and test purposes.
The associations are particularly critical of the court decision regarding the restriction of the possibility of legal action and the lack of professional disputes by the court.
Two accident reports are available that currently do not give a positive forecast for the construction of the US electric car manufacturer's factory.
However, this is a prerequisite for permits under the Immission Control Act, as the environmental associations said.
So far, the car factory has not received an environmental permit under the Federal Immission Control Act.
Tesla is therefore building with early approvals.
The final decision is still pending.
The timing is unclear.
