The Dubai International Financial Center Courts signed a joint cooperation agreement with Emaar Properties to promote the wills service provided by the first court to adopt the English-speaking Anglo-Saxon litigation system in the UAE.

A statement issued yesterday said that the agreement aims to raise the awareness and interest of real estate owners affiliated with Emaar Properties in the unique Wills Registration service, which allows investors and residents additional protection for the future of their real estate investments in the country.

Wills Service

It is noteworthy that the court's wills service was launched in 2015, as a joint initiative with the Dubai government, to give non-Muslim residents and investors in the country an appropriate option to transfer their assets or appoint guardians for their children, in accordance with the instructions mentioned in their wills.

As part of the UAE government’s commitment to the effective use of advanced technologies and digital platforms to continue to provide services to the public during the “Covid-19” pandemic without interruption, the DIFC Courts in 2020 benefited from its digital infrastructure to provide video calls for probate records, and the Dubai Financial Center Courts also developed The global feature of making video calls over the Internet, to connect dealers with the Wills Registration Service, whether via smartphone, tablet or computers, to register their Wills remotely.

The new system now allows for the testator and two witnesses to meet via video call, rather than having to be physically in the same place as was previously the case.

The wills can then be uploaded directly through the system, and electronic signatures can be attached to approve the will after being approved by witnesses.

Automated crafting

The DIFC Courts provide an automated online wills drafting service for real estate wills, with comprehensive explanatory notes attached if an individual wishes to draft a will independently.
