At the top of the list of characteristics sought by buyers, outdoor space is a real plus for a home.

Arbor, garden greenhouse, kiosk or even swimming pool, many arrangements allow to optimize the square meters.

But do you really know under what conditions you can get started?

Escape the paperwork

The town planning rules leave a relative freedom of action to create annexes on a ground.

Temporary installations such as an above-ground swimming pool, an arbor or a trampoline do not require any authorization as long as they are removable and are installed less than 3 months per year.

For permanent work, you are also at ease as long as your tool shed does not exceed 5 m2 in area and 12 m in height.

You therefore have no administrative formalities to follow if you want to install a small garden shed, a fixed barbecue, a kiosk or even games for children such as a slide or swings.

In the case of a permanent garden greenhouse, the frame must not exceed 1.80 m in height.

As for your pool, only a pool of less than 10 m2 uncovered can avoid paperwork.

Statements ...

As long as you think small, you have free rein to beautify your garden (subject to any restrictions in the condominium regulations).

Conversely, to realize your dreams of greatness, you will have to go through administrative procedures.

In terms of swimming pools, it is most often the prior declaration of work filed with the town hall that is required.

This formality is necessary for a pool with an area between 10 m2 and 100 m2 and where the shelter is less than 1.80 m high.

Likewise, if your garden shed has an area of more than 5 m2 on the ground or measures more than 12 m in height, you will need to obtain an urban planning authorization (declaration or permit).

... and taxes

In addition to the amount of your work, you will also have to give its share to the tax authorities. Any construction requiring an urban planning authorization is in fact subject to the development tax which is due only once, within 6 months of the issuance of this administrative agreement.

Its amount corresponds to the closed and covered area multiplied by the rates set by the municipality and the department (as well as the region in Île-de-France) which share its payment.

The whole is multiplied by a fixed value revised each year by the State according to the construction cost index.

It went from 705 euros in 2017 to 759 in 2019, reaching 767 euros per m2 for 2021 (and 870 in Île-de-France).

On the other hand, a specific flat-rate value of 200 euros applies per m2 of swimming pool, against 10 euros per m2 of photovoltaic panel surface.

Exceptions to the rule

It is possible to avoid the development tax in certain cases.

  • Take advantage of an allowance: a reduction of 50% is provided for the first 100 square meters of your home.

If your house is 80 m2, you can therefore carry out an extension of 20 m2 without having to pay this tax.

  • Benefit from an exemption: municipalities and inter-municipal authorities can choose to exempt, in part or in full from their share, individuals who finance the construction of their main residence with an area of more than 100 m2 with an eco - zero rate loan (eco-PTZ).

This exemption may also apply, depending on the decision taken, to a garden shed, a dovecote or a dovecote subject to prior declaration.

You can calculate the amount of the development tax using the simulator available on the website of the Ministry Cohesion-territoires.gouv.fr.
