China News Service, Nanning, January 14 (Liu Changlin, Yi Yelin) Nanning Customs reported on January 14 that recently, the Qinzhou Intermediate People’s Court has investigated the Nanning Customs Anti-smuggling Bureau under the Qinzhou Customs Anti-smuggling Sub-bureau of "2020.1.1" Fan XX. The first instance judgment was made in the case of smuggling imported white sugar.

  The court sentenced the first offender, Fan XX, to 13 years in prison for smuggling ordinary goods and articles, and fined 32 million yuan. Other key members of the gang were sentenced to fixed-term imprisonment ranging from 10 to 13 years, and sentenced to 1.5 million to 350. Fines ranging from ten thousand yuan.

  The case was initiated by the Qinzhou Customs Anti-smuggling Branch on January 1, 2020.

On the same day, under the unified command of the Anti-smuggling Bureau of the General Administration of Customs, the Nanning Customs Anti-smuggling Bureau and the Shijiazhuang Customs Anti-smuggling Bureau carried out a joint operation, mobilizing more than 110 police officers to carry out centralized arrests in Nanning, Dongxing, Shijiazhuang, Hebei, Xingtai, Hangzhou, Zhejiang and other places. Arrested, successfully arrested 10 suspects such as Fan XX, destroyed 4 suspected smuggling sugar gangs with false names, seized 675 tons of sugar on the spot, and frozen more than 40 accounts involved.

  It has been verified that from May 2018 to June 2019, a criminal group led by Fan XX declared imported sugar as a premixed candy powder through general trade channels using false product names, evading customs supervision, from Qinzhou, Guangxi. The port and shore smuggled 73 votes of imported white sugar from Thailand, totaling 11,478 tons, with a case value of 79.7692 million yuan.

  The successful cracking of this case was the first shot of the "National Sword 2020" anti-smuggling joint special operation. It was listed as the first-level case of the Anti-smuggling Bureau of the General Administration of Customs and was awarded the "Top Ten National Tax Collection and Administration Cases."

  According to the provisions of Article 153 of China’s Criminal Law, “Smuggled goods or articles that evade the tax payable are particularly large or have other serious circumstances shall be sentenced to more than 10 years of fixed-term imprisonment or life imprisonment, and shall also be sentenced to evasion. The amount of tax paid is more than one and five times the fine or property confiscated.” According to Article 16 of the "Interpretation of the Supreme People’s Court and the Supreme People’s Procuratorate on Several Issues Concerning the Application of Laws in Handling Criminal Cases of Smuggling," If the amount is more than 2.5 million yuan, it should be deemed as "evading and paying a particularly huge amount of tax."

The behavior of Fan and others constituted the crime of smuggling ordinary goods, and it was found that the amount of tax payable for evading was extremely large, and ultimately could not escape the severe sanction of the law.
