Decided to impose anti-dumping duties on imports of EPDM rubber originating in the United States, South Korea and the European Union from December 20, 2020.

The implementation period is 5 years.

  In accordance with the provisions of the Anti-dumping Regulations of the People’s Republic of China (hereinafter referred to as the “Anti-dumping Regulations”), on June 19, 2019, the Ministry of Commerce (hereinafter referred to as the investigation authority) issued Announcement No. 29 of 2019, deciding on the Initiated an anti-dumping investigation with the EU's imported EPDM rubber (hereinafter referred to as the product under investigation).

  The investigating authority investigated whether there is dumping and dumping margin for the product under investigation, whether the product under investigation has caused damage to the domestic EPDM rubber industry and the degree of damage, and the causal relationship between dumping and damage.

According to the investigation results and Article 24 of the Anti-Dumping Regulations, on October 23, 2020, the investigation authority issued a preliminary ruling announcement, preliminarily determining that there is dumping of imported EPDM rubber originating in the United States, South Korea and the European Union. The EPDM rubber industry has suffered material damage, and there is a causal relationship between dumping and material damage.

  After the preliminary ruling, the investigating authority continued to investigate dumping and dumping margin, damage and damage degree, and the causal relationship between dumping and damage.

  The investigation authority finally determined that there was dumping of imported EPDM rubber originating in the United States, South Korea and the European Union, and that the domestic EPDM rubber industry was materially damaged, and there was a causal relationship between dumping and material damage.

  Therefore, in accordance with Article 38 of the Anti-Dumping Regulations, the Ministry of Commerce proposed to the Tariff Commission of the State Council to impose anti-dumping duties. The Tariff Commission of the State Council made a decision based on the recommendations of the Ministry of Commerce. Effective December 20, 2020, Imported EPDM rubber originating in the United States, South Korea and the European Union is subject to anti-dumping duties.

  From December 20, 2020, import operators shall pay corresponding anti-dumping duties to the customs of the People's Republic of China when importing EPDM rubber originating in the United States, South Korea and the European Union. Anti-dumping duties are levied on the basis of the customs-approved customs value, and the calculation formula is: anti-dumping duty amount = customs duty-paid price × anti-dumping duty rate. The import value-added tax is levied based on the customs-approved value plus customs and anti-dumping duties as the taxable value. The implementation period is 5 years from December 20, 2020.
