The State Administration for Market Supervision and Administration today announced the "Interim Regulations on Regulating Promotional Behavior", focusing on the hot phenomenon of "promotion", further regulating the promotion behavior of operators, maintaining the order of market competition, protecting the legitimate rights and interests of consumers, and further optimizing the market environment.

It is understood that the regulations will come into effect on December 1, 2020.

  The "Interim Regulations on Regulating Promotional Behaviors" put forward clear requirements on the basic norms that operators should comply with in promotional activities.

If false information is not to be used to deceive or mislead consumers or the relevant public, and to fulfill the promise, the gifts must comply with relevant national regulations.

It also stipulates the rules that e-commerce platform operators, as the providers of trading venues, should abide by when organizing the platform operators to carry out relevant promotional activities, and the obligation to assist market supervision departments in conducting supervision and inspection.

  The "Regulations" make further provisions for business operators to adopt a rewarded sales method for promotion operations.

Clarified the categories of prize-winning sales, refined the criteria for identifying improper sales with prizes, and increased the maximum prize amount for prize-winning sales from the original 5,000 yuan to 50,000 yuan. Obligations in the sales process are stipulated to provide clearer guidelines for corporate compliance.

  The "Regulations" clarify that if there are additional conditions or time limits for price promotion activities carried out by operators, they should be clearly marked.

Regarding the phenomenon that operators "raise prices first and then discount prices" when carrying out promotions, clearly stipulate the basis for discounts and price reductions.

  In addition, the "Interim Provisions on Regulating Promotional Behaviors" in the chapter "Legal Liability" strengthen the convergence of laws and regulations such as the Anti-Unfair Competition Law and the Price Law.

Clarify issues related to the application of the law, such as false propaganda, commercial bribery, or unfair sales with a reward in promotional activities, the relevant provisions of the Anti-Unfair Competition Law shall be applied for punishment.
