The Government has approved this Tuesday the Royal Decree that regulates the advertising of the online betting and gambling sector, the project that appeared in the PSOE-Podemos government agreement and that was presented last February, just before for the pandemic to break out.

The Minister of Consumption, Alberto Garzón, has assured during the press conference after the meeting of the Council of Ministers that this law

According to Garzón, in recent years investment in advertising for gambling and betting "has exploded in an extraordinary way, to the point that they have inundated daily life and that of the media."

The rule prohibits audiovisual advertising of the game outside the hours of one to five in the morning.

Non-compliance includes fines of up to one million euros and the suspension of business activity.

The new text adjusts the content of advertising messages to protect the most vulnerable (minors, young people and people with addiction) and prohibits bookmakers, for example, from issuing player recruitment bonuses.

Companies may only direct their offers to registered and verified customers, so that they are not minors or people who have shown pathological behaviors in the activity of the game.

Clubs

may not sign sponsorship contracts with bookmakers that involve advertising on the players' jerseys

and kits.

Nor will it be possible to show betting advertising in sports stadiums, when they host events broadcast live, outside the established hours.

Advertising on the Internet may only be done on the portals of the gaming companies and in those advertisements that are broadcast during the permitted hours, people or characters of public relevance or celebrities may not appear.

Nor can the game be associated with success in the messages.

Non-compliances will be serious and operators may be penalized with a fine of between 100,000 and one million euros and with

the suspension of their activity in Spain for a maximum period of six months.

From that moment, new contracts contrary to the measures contemplated in the Royal Decree may not be signed.

For those already signed and that are in force at this time, deadlines are established that go until the summer of 2021, coinciding with the end of the sports season, although the private agreements between clubs and operators have been signed for a longer time.

Asked if the Ministry has measured the impact that this measure will have on employment and if palliative measures are envisaged in this regard, Garzón has assured that "they exist only to a small extent."
