The right to omit one's medical history

If cancers are still the leading cause of death in men and the second in women, according to Public Health France, these diseases are killing less and less.

The death rate fell by 2% per year for men and 0.7% per year for women between 2010 and 2018, according to the National Cancer Institute.

To benefit from this measure, it is not only necessary that the loan contract ends before the 71st birthday of the insured, but also that his treatment has been completed for several years without any relapse.

Previously, the right to be forgotten applied after five years of recovery, when the claimant had cancer before turning 18.

But since September 1, 2020, the measure has been extended up to 21 years.

On the other hand, when the diagnosis fell after this age threshold, it is necessary to wait ten years from the end of the therapeutic protocol so that this medical history no longer has any influence on your file.

If you are in one of these situations, you therefore do not have to declare your former cancer and can benefit from standard borrower insurance, without any additional premium or exclusion of cover relating to this pathology.

And if you inadvertently declare your illness, the insurer's medical service will not have to take it into account.

No extra premium for certain pathologies

Apart from the right to be forgotten, borrowers must mention all their critical illnesses.

However, the “reference grid” established by the Aeras agreement lists the pathologies for which this declaration must have a limited impact on your insurance, as long as your credit does not exceed 320,000 euros and it ends, at the latest. , when you turn 70.

In certain cases, no additional premium or exclusion of guarantee can be imposed.

This concerns some old cancers whose healing time is less than that of the right to be forgotten, but also hepatitis C beyond 48 weeks of healing.

In other cases, such as HIV, cystic fibrosis or invasive breast cancer, the additional premium or warranty limitations will be capped and limited.
