Real estate professionals estimate that 3 to 5% of rentals are affected by unpaid rents. A calamity for small owners who often rely on this amount to meet the deadlines of their mortgage. However, between the cost and the length of the recovery procedures, it is very quickly several thousand euros that are missing.

To avoid finding your head underwater, it is strongly recommended to take out an unpaid rent guarantee (GLI).

Attractive guarantees

Offered freely by private companies, this insurance was used initially to supplement the old rental risk guarantee (GRL), the public system replaced since 2016 by the Visale guarantee. But, faced with the restrictive criteria of this public bond, private insurance retains its relevance. The GLI generally includes several types of protection, namely the reimbursement of rents and charges not paid by the tenant, the assumption of the costs of repair consecutive to the degradations which he could commit, as well as procedural costs related to these situations (bailiff, lawyer, intervention of a locksmith ...).

Some contracts also include, basic or optional, the cover of a non-rental period following an unforeseeable departure of the tenant or, more generally, any period of vacancy between two occupants. This last guarantee is far from being negligible when you know that the level of vacancy can vary from a few days to several weeks, depending on the city.

Choosing the right contract

While most private insurers offer the same type of cover, their terms and costs vary on the other hand, depending on the contract. Before signing, make a comparison. Regarding the payment of unpaid bills, Maif, for example, pays up to thirty months' rent up to a limit of 69,000 euros, from the first unpaid payment and without deductible, against 70,000 euros covered over an unlimited period at E-Gérance, subsidiary of Nexity. In all cases, it is necessary to wait three to four months after the acknowledgment of default to receive the compensation. As for the price of this protection, it varies from 2 to 4% of the amount of the rent depending on the companies (sums 100% deductible from property income).

To subscribe to this type of contract, you still have to be able to show your freedom. Faced with the increase in rental disputes, insurers have strictly regulated the guarantee for unpaid rents. In most cases, the rent must not exceed 2,500 euros monthly (charges and taxes included) and not represent more than a third of the tenant's income. Likewise, insurers impose a rigorous selection of occupants by means of proof of solvency (employment contract, payslips, tax notice, etc.), as well as a precise procedure for unpaid debts. However, the slightest breach of these prescriptions can justify a refusal of care in the event of a glitch. Note: a lessor covered by a GLI cannot ask the tenant to have a deposit, unless the latter is a student or an apprentice.

A public bond

The Visale guarantee has put in place a public guarantee scheme since 2016:

  • Target audience: all young people under the age of 30, regardless of their professional situation, as well as those over 30 who are salaried seeking housing within six months of taking up their job on a precarious contract or during a trial period. CDI or after their transfer.
  • Housing conditions: the rent (including charges) must be less than 1,500 euros in Paris and 1,300 euros in the regions, knowing that the tenant must earn at least double that amount (50% effort rate). However, no means test is imposed on scholarship students if their rent is less than 600 euros in the region (800 euros in Ile-de-France).
  • The procedure: the tenant requests his certificate of eligibility online on www.visale.fr and gives it to the lessor, who in turn creates his personal space to receive a proposal for a guarantee contract.
