Two real estate students demanded the establishment of a federal body, in charge of organizing real estate contracts between the parties to the real estate system, noting that the lack of that body opened the way for a significant increase in real estate disputes before the courts.

The Federal Competitiveness and Statistics Authority revealed, in a recent report, based on the statistics of the Ministry of Justice, that the total number of land disputes and real estate claims during the year 2019 reached 1902 disputes, compared to 1,560 cases in 2018.

The CEO of Medallion Real Estate Consulting, Masoud Al-Awar, said that financial disputes between the parties to the real estate system are among the main causes of disputes and real estate claims on lands.

Al-Awar called for the establishment of a federal body responsible for organizing real estate contracts between the parties to the real estate system, by defining the general frameworks of contracts, ways to resolve disputes amicably, and the timing of this, which contributes to amicable settlement of disputes, and reduces disputes before the courts.

And he considered that the absence of a federal body regulating contracts and resolving disputes opened the way for a significant increase in real estate disputes before the courts over the past five years, stressing the importance of developing legislation to solve real estate disputes, to facilitate access to solutions without resorting to the judiciary.

For his part, a member of the Board of Directors, Chairman of the Real Estate and Contracting Committee in the Abu Dhabi Chamber of Commerce and Industry, Dr. Mubarak Al-Amri, agreed on the importance of a federal body to regulate real estate contracts between the parties to the real estate system, pointing out that this body determines many organizational matters, particularly the general frameworks. For contracts, and ways to settle disputes amicably, which reduces the use of courts to resolve them.

Al Amri pointed out that the increase in disputes is largely related to the lack of knowledge of the various parties in the real estate system of the rights and duties of each party, and this may be due to the lack of clarity of rights and duties in the contracts themselves.

He believed that the increase in the number of disputes and real estate claims is directly related to the increase in the volume of transactions and transactions on land, as well as the increase in real estate activity in general.
