Commerce today asked the government to rectify, once again, the controversy of prohibiting sales. Within 24 hours they were banned, disapproved , banned again, and now the sector is asking for a new rectification , which, if heard by the Executive, would already be the fourth change in two days.

The controversy dates back to a ministerial order published in the BOE last Saturday, in which, in an additional provision almost at the end of the document, Health prohibited sales "to avoid crowds."

Hours later, at the request of the textile employers, Acotex, the Ministry of Industry, Commerce and Tourism clarified that the order did not prohibit sales, but that it was against crowds. However, he processed a query to Health to make sure and the answer came in the afternoon at the press conference of the department's head, Salvador Illa, who returned to the starting point: sales are prohibited because they encourage crowds.

First yes, then no, then yes ...

In the face of such confusion, the various associations in the sector asked the Government for clarification and expressed their discomfort, considering that this creates legal insecurity for companies, which no longer know whether or not they can carry out promotions.

"The manifest contradictions between what was published in the ministerial order, the clarifications from the Secretary of State for Commerce and the statements of Minister Illa cause serious legal insecurity for the sector," they point out from the Spanish Confederation of Commerce (CEC).

From Anged, the association of large distribution companies, considers that an unnecessary debate has been created, since the key to the agglomerations "is not in the sales or promotions but in the capacity limitations (30%) and the safety distance of 2 meters. With these measurements, it is impossible in practice for agglomerations to occur. "

And now ... not again?

" It is unthinkable to think that in the non-food trade there will be an avalanche of customers who have suffered in food establishments. In these, it has been possible to organize well in a general way. In the case of food, we are talking about daily consumption, while for the rest of the commerce the frequency of purchase is much lower ", they defend.

The CEC has sent two letters to the Ministry of Commerce and the Ministry of Health, in which it requests a rectification and considers it unlawful to prevent establishments from making these promotions.

The sales are a key moment for the sector because it is when they are released from the accumulated seasonal stock , that is, from the garments of the season that has ended and that has not been sold. At this juncture in which trade has been closed for two months and without selling anything, it is even more important to be able to release that stock, they argue.

According to the CEC, the discounts are governed by the Retail Trade Management Law, so to make a modification of this caliber it would be necessary to modify the law.
