Xu Chuanhan introduced that Article 10 of the "Trademark Law of the People's Republic of China" stipulates several situations in which it cannot be used as a trademark, and it is not clear whether a person's name can be used as a trademark, but in its first paragraph (8), it is clearly "harmful to socialism." "Morality or other adverse effects" shall not be used as trademarks.

Article 5 of the Supreme People's Court's "Regulations on Several Issues Concerning the Trial of Several Administrative Cases in Which Trademark Authorization Is Determined" stipulates that: if a trademark mark or its constituent elements may have a negative or negative impact on China's social public interests and public order, the people's court may determine that "Other adverse effects" as provided for in Article 10, paragraph 1 (8), of the Trademark Law. Xu Chuanhan introduced that whether a trademark can be registered with the name of a public person also needs to be considered in combination with the actual situation.
