Mediaset has won one of his pending matches with the League, although there are more losers. The Supreme Court has dismissed the appeal of the body chaired by Javier Tebas and protects the interpretations of the National Court and the CNMC for the issuance of informative summaries of the 90-day League match per game. That is, that minute and a half would not work as a stop for the whole day, but for each of the meetings, which would have up to 15 minutes of summary images of the day without having to pay them. Paid summaries, therefore, are devalued, or at least may not be revalued with a restrictive ruling from the Supreme Court.

"In case of conceiving the 90 seconds on the total of the parties, the information of each one of them would not reach more than 15 seconds, which is manifested insufficient , because it does not allow to develop the information properly, which would be very limited, restricted and scarce for each party and would not allow to achieve the expected objectives that the information has access to the public, "said the Supreme in his ruling, to which EL MUNDO has had access.

This position is a setback for the marketing model of the League, which among its lots has one focused on the summaries of First and Second Division, but indirectly also for the company that took that package in 2018, corresponding to the 2019 seasons / 20, 2020/21 and 2021/22, that is, Mediapro.

The producer of which Jaume Roures is a reference partner sells these images to the channels and television spaces , operations that in each case reach millions of dollars. In Mediapro remember that the company sells these images to programs, not to the news, which are the only formats that can offer 15 minutes per day. However, different sources of the sector consulted by this newspaper recognize that, if the viewers have been able to see these summaries in the news, there would be a devaluation of any subsequent viewing.

TVE, Mediaset and the regional ones pay Mediapro to include those images in their programs. However, in view of what was stated by the Supreme Court and previously by the CNMC and the National Court, any informative program could stretch its summary of the day up to 15 minutes. The criteria of the CNMC have allowed programs such as Deportes Cuatro (Mediaset) or Jugones (Atresmedia) to be considered informative in spite of separating from non-sports news, a practice they carry out in order to introduce advertising and sponsorships.

Five years of conflict

Royal Decree-Law 5/2015, which amended the General Law of Audiovisual Communication 7/2010, stated that the issuance of summaries in chains that did not hold the rights would be framed "in a general information, deferred and with a duration less than 90 seconds. "

Some formats such as Deportes Cuatro (popularly known then as Los Manolos ) based their content on these summaries, so Mediaset raised this cause before the CNMC. In fact, as of 2016 and with the Competition verdict on the table, the criterion that the 90 seconds is per game and not per day is already applied. The Supreme has confirmed this aspect, subject to confusion that appeared in article 19 of the General Law of Audiovisual Communication.
