12th division of the Seoul Administrative Court is interrogating the case of a request for suspension of enforcement of the effective disciplinary action issued by Prosecutor General Yoon Seok-yeol at 2 pm today.
On today's date, a special attorney on the part of President Yoon Suk-yeol and a representative from the Ministry of Justice who decided the disciplinary action will be present.
There are two main issues.
First of all, it is whether it can be regarded as irreparable damage that Yoon was unable to perform his duties for the time being after being suspended for two months.
Yoon argues that the violation of the prosecution's political neutrality and independence for two months is an irreparable loss.
In response, the Ministry of Justice is refuting that it is not possible to dispose of suspension of duties such as suspension from the prosecutor general if it is as claimed by Yoon.
Both sides are fighting fiercely over whether the disciplinary committee process was fair.
President Yoon argues that the problem is that he enforced the disciplinary committee only by speculation without any apparent disciplinary charges, and rejected the challenge of the disciplinary committee in question.
The Ministry of Justice refutes that there is no problem, saying it has held the disciplinary committee twice to ensure procedural fairness and legitimacy.
In the case of major cases, as the court concludes with speed, the fate of President Yoon is likely to be concluded within this week at the latest as early as today.
