The Moscow City Court overturned the verdict in the case of footballers Alexander Kokorin and Pavel Mamaev, who in October 2018 became participants in two fights in the center of the capital, and issued a new verdict. In accordance with it, charges of hooliganism were dropped from Rostov's midfielder, children's coach Alexander Protasovitsky, as well as Kirill Kokorin, and the imprisonment they served last year was replaced with a year of correctional labor. At the same time, the verdict and punishment of the forward "Spartak" remained the same.

The ruling comes into force today, and now the partially acquitted persons involved in the case can count on rehabilitation and monetary compensation. Mamaev's lawyer Igor Bushmanov said that it is not yet known whether his client will use this option. He added that the prosecutor's office must bring a written apology for the illegal bringing to criminal responsibility. Vyacheslav Barik, who represents the interests of Kokorin Jr., also counts on rehabilitation.

Despite the mitigation of the sentence, Mamaev's defense remained unhappy with the outcome of the hearing. Bushmanov called the verdict "half-hearted" and announced his intention to further defend the interests of the client. According to the lawyer, the maximum penalty that his client should receive is a fine of 40 thousand rubles.

“Despite the acquittal, there is every reason to appeal further. Although we assumed that the case would be a fat point. Such an elementary business takes a long time. It is not yet clear how long it will take to finish everything. A second year student of the university will be able to correctly qualify all actions, "- quotes Bushmanov's words" Championship ".

The defense of Kokorin Sr. also intends to appeal the decision of the Moscow City Court.

“We do not agree with this verdict, we will appeal it to the cassation instance ... There was no hooliganism on the part of Sasha, we also believe that he should be acquitted on the basis of the episode with the driver Vitaly Solovchuk,” RIA Novosti quotes lawyer Tatyana Stukalova.

Neither Kokorin nor Mamaev were present at the announcement of the verdict, since at the moment they are at the disposal of their teams, which are preparing for the start of the new RPL season. At the same time, Protasovitsky spoke at the meeting. He admitted his guilt in only one episode. And after the trial, Kirill supported the forward of Spartak.

“It's unpleasant that the court made such a decision on Sasha. And for us there is no complete satisfaction. If he had no changes at all, then they removed only the article “hooliganism”, but everyone had a criminal record, ”Sport-Express quotes Protasovitsky.

The new verdict was commented on in the Public Monitoring Commission (POC). According to the executive secretary of the organization, Ivan Melnikov, the defendants in the case were kept in a pre-trial detention center for too long, where they spent eight months.

“The choice of a preventive measure should be used very selectively. The guys are famous, they would not be able to hide anywhere, everyone would recognize them. Being in an isolation ward would be redundant. I hope the courts will be more selective in choosing a measure of restraint in the future. Alexander was in danger that he would not be able to enter the field, given his knee injury. It is presumptuous to say that you can get highly qualified medical care in a pre-trial detention center, ”Melnikov said.

Recall that at the beginning of October 2018, the Kokorin brothers, Mamaev and Protasovitsky became participants in two brawls in which the driver of Channel One Olga Ushakova Vitaly Solovchuk, the head of the Mospromtorg department Denis Pak and the general director of FSUE "NAMI" Sergei Gaisin, were injured.

The investigation lasted several months, and in May 2019, the Presnensky Court of Moscow found all four defendants guilty and sentenced the Kokorin brothers to one and a half years in prison, and Mamaev and Protasovitsky to a year and five months in a general regime colony. The Moscow City Court dismissed the appeal of the defense. Football players were released on parole in September of the same year.

Nevertheless, in March of this year it became known that the defense intends to appeal the verdict. According to the lawyers, the court did not take into account a number of factors when passing the verdict. In particular, they talked about the degree of participation of each of the convicts in the brawls and the actions of the victims who could provoke the players. In addition, they questioned the hooligan motives on which the prosecutor's office insisted.

Two months later, the Second General Jurisdiction Court of Cassation overturned the verdict, finding violations of the criminal and criminal procedure laws. This decision was the first step towards the partial acquittal of the convicts, and the case was sent to the appeal.

On July 31, a meeting was held in which Kokorin and Mamaev took part. At them, the prosecutor announced a demand to leave the original verdict in force, and the lawyers insisted on acquittal. Those who have served their sentences have repeatedly stressed that it is not compensation that matters for them, but only a fair decision.
