China News Service, March 29: The State Intellectual Property Office held a regular press conference for March 2024 on the 29th to introduce the recent key work of the State Intellectual Property Office. Ge Shu, deputy director of the Patent Office of the State Intellectual Property Office and director of the Strategic Planning Department, said at the meeting that so far, the pilot areas have received more than 13,000 applications for data intellectual property registration and issued more than 7,000 certificates.

  At the meeting, a reporter asked that the government work report pointed out that it is necessary to "deeply promote the innovative development of the digital economy, improve the basic data system, and vigorously promote the development, openness, circulation and use of data." What work has the State Intellectual Property Office carried out to leverage the advantages of the intellectual property system and support the development of the digital economy?

  In this regard, Ge Shu said that in recent years, the State Intellectual Property Office has given full play to the functions of the intellectual property system, actively helped cultivate new drivers of economic development, and promoted the creation of new advantages in the digital economy. Mainly carried out three aspects of work.

The first is to improve the system and promote the efficient use of digital resources.

Promote the establishment of data intellectual property protection rules to better promote the reasonable flow, full utilization, and effective protection of data. It proposed the basic principles of "four sufficiencies" in constructing data intellectual property protection rules, and researched and sorted out a series of key issues including protection objects, protection subjects, empowerment methods, rights content, protection methods, application models, etc., and conducted research in 17 provinces across the country. The city has launched a pilot project. So far, the pilot areas have received more than 13,000 data intellectual property registration applications and issued more than 7,000 certificates. These data have a wide range of application scenarios, including manufacturing production data, sales and consumption data, etc. The main applicants are enterprises, accounting for 90% above.

The second is to strengthen protection and promote digital information technology innovation.

Continuously improve the patent review rules for new fields and new business formats such as the Internet, big data, and artificial intelligence, and strengthen the source protection of intellectual property rights in the digital economy. Carry out special management of intellectual property protection on e-commerce platforms, strengthen the comprehensive support role of the intellectual property protection center in patent pre-examination, rights protection assistance, information services, etc., and promote the integrated development of the digital industry and the real economy. Strengthen cooperation with courts, market supervision and other departments, and strengthen the connection between administrative and judicial protection. Data intellectual property certificates, as relevant proof of data held by data processors, have been specifically applied in judicial practice in data rights disputes.

The third is to promote application and stimulate the vitality of digital economic development

Support enterprises, universities, and scientific research institutions to carry out patent navigation focusing on key areas such as artificial intelligence and integrated circuits, improve the starting point of research and development, and optimize patent layout. Support the construction of intellectual property operation centers and improve the digital industry intellectual property application platform around the Internet of Things, smart life and other contents. Support data intellectual property transaction financing. Taking Zhejiang as an example, the amount of data intellectual property pledge financing exceeds 2.2 billion yuan, which has played an active role in promoting data circulation and supporting enterprise development.

  Not long ago, the State Intellectual Property Office held the second plenary meeting of the data intellectual property work guidance expert group. The participating experts put forward work suggestions on many key issues in data intellectual property protection. The State Intellectual Property Office will follow expert advice and combine pilot practical experience to further improve data intellectual property protection rules to better support the development of the digital economy.
