The Tsunami Democratic investigation for terrorism continues in the National Court.

The court that reviews the decisions of the judge in the case has issued a resolution with two messages for the accused: that they cannot oppose the procedures agreed upon by the investigator and that the Supreme Court has already said that there are indications of terrorism, so the cause it doesn't close.

The order of the

Third Criminal Section

responds to the appeal presented by one of the 10 investigated,

Oriol Soler

.

His defense had opposed one of the rounds of proceedings agreed upon by the investigating judge,

Manuel García-Castellón

, although the Chamber interpreted that, in reality, the mere existence of the case opened in the Court was being questioned.

And it also answers that.

"It is intended that the procedure be archived [...]. Thus, it is not the resolution of the practice of proceedings that is being appealed, but rather - which is procedurally unacceptable - the existence of the criminal case. This claim has also been rejected by the [Supreme Court order] which indicates the existence of indications that serious crimes of a terrorist nature have been committed by the members of the Tsunami Democratic movement," says the Chamber chaired by Judge Alfonso Guevara, also

rapporteur

of the resolution .

The court recalls that in that order of February 29, the Supreme Court agreed to stay with the investigation that affects former president

Carles Puigdemont

and the also arrested and fled

Ruben Wagensberg

.

"Also agreeing," he adds, "to return the case to the Central Court of Instruction No. 6 in relation to those not certified, among others, Oriol Soler Castanys."

The Court thus ruled on the competence to continue investigating Tsunami, an option that was only possible by interpreting the terrorist nature of the evidence of crime.

The court still had a pending appeal from the Prosecutor's Office in which it was requested to send the case to the courts of Catalonia as it did not detect terrorism, but mere public disorders.

The order issued this Monday anticipates the rejection of prosecutor Miguel Ángel Carballo

's appeal

.

In addition to continuing with the open case, the court rejects the request of the investigated Soler to prevent new proceedings in the case.

He reminds him that to a similar appeal by

Josep Lluís Alay

- Puigdemont's right-hand man and defended by the same lawyer, Gonzalo Boye - he already responded that the decision to carry out proceedings cannot be appealed, only the decision not to carry them out.

The appealed proceedings that continue were related to the incidents at the El Prat airport in protest against the condemnations of the

process

, to incidents during the day of reflection for the 10-N 2019 elections, to the cutting of the border with France in the AP7 and the identification of who would have provided information to Tsunami about a possible visit of the King to Catalonia.
