Generalitat

has opened a sanctioning file against the company owned by

Xavier Trias

's family , which manages the Ballena Alegre campsite located on the Costa Brava, for two "very serious urban planning violations."

In addition, it orders the closure of 89 bungalows and "four illegal swimming pools" built irregularly on the seafront.

The case broke out in May of last year, when this newspaper reported that the

Court of Instruction number 4 of Figueres

is investigating a possible crime of urban prevarication and one against the planning of the territory committed by those responsible for the La Ballena Alegre campsite, located in the town of Sant Pere Pescador (Girona) and owned by the Camping Car company, which is managed by part of the Trias family.

Specifically, at the head of the company is the eldest son of the former mayor of

Barcelona

- Àlex Trias Arraut - and other members of the family of the independence leader's wife are on his board of directors.

In fact, the

Prosecutor's Office

already reported in 2021 that around a hundred bungalows in this establishment were built irregularly as they were raised above a coastal protection easement area (developable land only with mobile accommodation).

In addition, the court investigates whether the management company had the alleged complicity of both municipal and state authorities.

Now and in parallel to the judicial process, the Department of

Territory of the Generalitat

has initiated a "complex procedure for the protection of urban legality" that includes a "sanctioning procedure" and a "procedure for the restitution of the altered legal reality" against the Trias family society.

A company "responsible for two very serious urban planning violations" that consist of the implementation of "89 bungalows / mobile homes and the construction of four swimming pools on non-developable land, with special protection", according to the Government file sent to the La Ballena campsite. orders the closure of the facilities since "irregular use of the campsite is taking place", a circumstance that "is generating an illicit private benefit" on the part of the Trias family company that manages the Ballena Alegre. .

In this sense, the Generalitat warns interested parties that if it is found that they fail to comply with "the suspension order" of the activity of the bungalows and swimming pools - that is, if they are not closed - the Prosecutor's Office may be notified to demand the corresponding criminal responsibilities for an alleged case of disobedience.

Regarding the fines, the Generalitat "orders the suspension" of the sanctioning procedure pending the judicial resolution of the case, which is being investigated by the Investigative Court 4 of Figueres.

However, the resolution includes a calculation of the amount to be paid, which would be around

187,000 euros

in the event that the payment was voluntary and there was a voluntary restoration of the space.

That is, if the bungalows and swimming pools built in a non-permissible natural space were demolished.

On the other hand, the fine without any reduction for assumption of responsibilities would reach

one and a half million euros.

A Civil Guard report on the Merry Whale case considers proven crimes that could lead to criminal liability, both for the company's managers, for the architects who issued reports in favor and for the builders who carried out the work on the bungalows.

The Civil Guard report relates with numerous graphic information that for years at the campsite "bungalows have been installed on a certain number of camping plots on delimited developable land without an urban planning action program or partial plan" to support it.

Some of these buildings found in the Ballena Alegre campsite have two floors, are built and are connected to the water and electricity supply network.

Therefore, according to current regulations, practically a third of the establishment is on "coastal non-developable land", which prevents the location of permanent accommodation.

That is, only "mobile or semi-mobile shelter" is allowed, which must "have wheels."
